Is it illegal to ride a bike while drunk? I didn't think so, but haven't really looked at that.

Other than perhaps public intoxication - not sure they were breaking any laws? Certainly does put fault into question, but still need to convict that driver, he killed people.

Now who is to say that they weren’t where they should not have been? Not to remove culpability from the driver, he was drunk and emotionally distraught.

But, you tar and feather a guy while speaking about the victim and lamenting the loss of someone of such exceptional character, gushing about how amazing they were as a person, making them sound like the were a saint above reproach.

Truth is that he got hammered with his brother and went for a bike ride and suddenly his young children are orphans.

Many bicycles today may also have electric or gas motors, and in these cases, an intoxicated cyclist will likely be violating the Highway Traffic Act and Criminal Code of Canada.

Knowing the US justice system I can see this getting tossed, or at least no jail time.

It doesn’t mean his case will be tossed. He was still intoxicated and involved in two fatalities. But what it does mean is that he can put on a defence that may mitigated both the criminal and civil penalties. He would of course have to show that their intoxication contributed to their behaviour that contributed to the crash. For him it is all about mitigation right now.

How were the brothers riding, side by side or staggered? What were they wearing at night? Did they ride in a reckless or dangerous manner? It is possible to find joint responsibility and still hold him accountable.

Id be lying if I say that never crossed my mind. Seeing the community come together for Johnny was very uplifting for me. Just because you didn’t mean to kill, doesn’t mean you shouldn’t be absolved. There are consequences to every action you make. This is the most unfortunate one.
