The league, in fact, approved the contract as was required by the (then current) CBA (2005 - S. 11.3).

I do agree with you that trading Luongo's contract away was not wise (but was that Gilman's or Gillis' fault?).

Widely known the team was warned prior to signing the contract the ignored the warning.

Oh, good ol' "widely known" - I've heard he's a pretty solid source of legit info. Reliable entities like the Squad and Trump all reference him frequently.

At the time there was a lot of talk about the league being angry with teams that were trying to find loopholes.

Loopholes to circumvent the cap.

TORONTO -- NHL Deputy Commissioner Bill Daly confirmed Wednesday that the contracts of Marian Hossa, Chris Pronger, Roberto Luongo and Marc Savard remain under investigation by the League and are subject to penalties that could include de-registration if the findings determine there was a violation of the circumvention provision written into the Collective Bargaining Agreement.

Daly said at the time those contracts were registered an advisory letter was sent to the clubs notifying them that the League was going to investigate "the circumstances under which the contracts were negotiated to see if there is potential circumvention." There is no time limit to those investigations.

I'll search for more on this sometime tomorrow or the next day.

But clearly Gillis and Gilman were playing with fire...

But we didn't care because we figured Lord Stanley was coming to town.

Why Canucks didn't later CBO Luongo though I'll never know...

Like the doc and Doyle said bad management (or interference from ownership), should have used a cbo, and if not that should never have traded that contract. I will agree with Doyle though, it’s absolute horseshit that the league is penalizing us. It would be interesting to hear what’s gone on behind closed doors on this issue. It will also be interesting if shea Weber decides to retire early cause his recapture penalty is ridiculous compared to Lou’s.

And we know Luongo retired for medical reasons. We know he accommodated the Panthers. We know this allows the Panthers to circumvent the cap implications for them having him on LTIR plus they must pay his salary. This should be investigated but it won’t be. All in all if it had to happened this was the best time for it. But it’s bogus that we are the only team to really suffer.

I remember Doc almost screaming to CBO the guy. Someone should have listened

Suggestion: Refuse to pay it. (or refuse to accept it on Vancouver's cap). File it in court and let it rot for years.
Because of the ramifications and negative press of a big drawn out cesspool of league negativity, my guess is, it might likely go-away.

Those other guys though are still on ltir right? They haven’t “officially” retired yet. This was shady shit by Florida and Lou, and bad management (owner interference) on Vancouver’s part. Why didn’t Florida trade him back to us for future considerations so we could place him on ltir, it would have been no skin off aqua’s ass to do that neither team has to worry about residual cap implications.

Thanks for the link below. But I don't see any evidence that would substantiate your immediately above statement.

Luongo's extension was signed in 2009. In the article segment below Daly indicated that, as of August 18th, 2010, certain contracts including Luongo's were under investigation and that "at the time of registration" of the contracts in question letters were provided to the respective teams indicating that the league would "investigate". The league obviously went ahead and approved those contracts despite its ongoing investigations.

Seems a lot more like post-event umbrage by an embarrassed league rather than pre-event warnings.

So far I see the blame for the results of the Luongo contract resting fully upon the bush league that was embarrassed by its own shitty contract drafting. To me, that is on the league rather than on Gillis or Gilmann.

That said, I fully agree with the argument that trading Luongo's contract away and losing control of it was a very unwise move. But I would expect that was more Gillis and less Gilman.
