As despicable as the acts of said troll were, I'm torn when it comes to the idea of throwing him in jail.

It's stated in the article that he has Asperger's... thus by definition he has problems relating to other people's emotions, and thus he was probably unaware of the damage he did to the relatives of those he mocked.

Whatever happened to the concept of intent?

At the same time, people with Asperger's tend to be extremely logical. Vulcan-like, if you say.
Thus the message "do this and you go to jail as a consequence" is probably more likely to work on people with Asperger's than on people in general. Thus if they jail this guy to send a message to the autistic/Asperger/related syndromes community, it may actually work. I assume the deterrent factor is much more vivid for this group than for normal, more irrational, people. Most criminals never take the getting caught part into their calculations. People with Asperger's actually might do so.

The jail term will in no way teach this guy to understand the emotions of other people. He may actually think he is being persecuted, and in a way he is, since what he did is actually rather consistent with his condition, and thus he is being jailed for what he is as much as for what he did.

Still. If the message this sentence sends out has an effect on other autistic/Asperger people's behaviour maybe it's worth it?

I'm not a great fan of the Chinese style "killing the chickens to scare the monkeys" approach to justice though.
